The Medicare Modernization Act of 2003 added prescription drug coverage to the Medicare Program. The new coverage, Medicare Part D, began providing coverage in January 2006. Under the Act, employers providing prescription drug coverage to Medicare Beneficiaries (not just retirees) are required to disclose annually whether the coverage is “creditable prescription drug coverage” via a formal disclosure notice to both Medicare beneficiaries as well the Centers for Medicare and Medicaid Services.
